PRIVACY NOTICE

 

The purpose of this privacy notice is to ensure that before you provide us with your personal data, you receive adequate information in a concise, clear and transparent manner about the most important information regarding the processing of your personal data.

 

MIELL GreenLife Kft. processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as GDPR) and the applicable Hungarian data protection legislation.

 

Privacy notice for data subjects who are individuals shopping through www.miellgreen.com

If you enter into a sales contract with the controller by placing an order via www.miellgreen.com and its acceptance by MIELL GreenLife Kft., we will process the following data concerning you in this context:

Name, address, delivery address (if different from the address), date of birth (only for purchases subject to age limit), email address, telephone number for the performance of the sales contract, for home delivery, data required for payment

The purpose of data processing: conclusion and performance of the sales contract, home delivery, fulfilment of the record-keeping and retention obligation as stipulated in tax and accounting legislation, fulfilment of the legal obligation related to the enforcement of claims provided for by law, return of products, identification of the data subject in the event of a complaint, investigation and settlement of the complaint

Legal basis for processing: performance of a sales contract, performance of a legal obligation

The data may be accessed by the employees and fulfilment partners of the controller who assist in the performance of the contract, such as persons performing financial, accounting, tax, legal, transport activities, data processors (if necessary for their performance), accountants (for the performance of accounting obligations), legal experts in the event of legal claims, and the competent authority or court in the event of a dispute. Access to data is strictly limited to a specific purpose.

The controller shall retain your personal data during the performance of the contract and for 8 years after the termination of the contract pursuant to Section 169 of Act C of 2000 on Accounting. If the data subject withdraws from the sales contract before its performance, provided that the legal conditions for such withdrawal are fulfilled, the data shall be deleted after the lawfulness of the withdrawal has been established.

If you do not wish to provide us with your personal data, the contract cannot be concluded between the parties and we will not be able to serve you.

 

Privacy notice for data subjects who register on www.miellgreen.com

If you register on www.miellgreen.com, we will process the following data concerning you to create your account and in connection with the operation of your account:

Name, username, email address, password

Purpose of data processing: creation of an account upon the data subject’s registration on the website and providing access to the functions of the account (e.g.: use of discounts for registered users)

Legal basis for processing: your consent.

Your personal data shall be kept until your account is terminated or your registration is cancelled.

Please note that by providing the data required for registration, the data subjects consent to the processing of their personal data by the controller for the purposes set out above. If you do not consent to the processing, please do not provide your data or register to create your own account.

You have the right to withdraw your consent at any time, i.e. to delete your account, and the withdrawal of consent, i.e. the deletion of your account, does not affect the lawfulness of the processing based on consent prior to the withdrawal. Privacy notice on the contact form at www.miellgreen.com

If you fill in the contact form on the MIELL GreenLife Kft. website at www.miellgreen.com, the controller shall process the following data concerning you in this context:

Name, email address, telephone number, other personal data provided by the data subject in the message

The purpose of the processing: to enable the data subject to contact the controller in relation to the products, services or job offers provided on the website, to enable the controller to identify the data subject, to contact the data subject by email or telephone, to enable the controller to make an offer, to provide the data subject with the necessary information in relation to the enquiry indicated in the contact form or to act on any other matter for which the data subject has contacted the controller,

Legal basis for processing: your consent

Your data may be accessed by the controller’s staff dealing with enquiries in connection with the contact form, by the competent staff in relation to the subject of the enquiry.

Your personal data shall be retained until your consent is withdrawn, but for a maximum of 2 years.

By providing their personal data, data subjects consent to the processing of their personal data by the controller for the purposes set out above. If you do not consent to the processing, do not use the contact form available on the website, do not send the form to the controller with the completed data.

You have the right to withdraw your consent at any time, i.e. to delete your account, and the withdrawal of consent, i.e. the deletion of your account, does not affect the lawfulness of the processing based on consent prior to the withdrawal.

 

Privacy notice for our contracting partners who are private individuals

If you enter into a contract with MIELL GreenLife Kft. as a private individual, we will process the following data concerning you in connection with this contract:

Name, mother’s name, address, postal address/address for service, tax identification number, private entrepreneur’s tax number, registration number, place and date of birth, bank account number, telephone number, email address;

Purpose of processing: making an offer, negotiating contractual terms, concluding, performing and terminating a contract, fulfilling the record-keeping and retention obligation required by tax and accounting law, fulfilling a legal obligation relating to the enforcement of claims provided for by law

Legal basis for processing: Performance of a contract, performance of a legal obligation

The data may be accessed by the employees and fulfilment partners of the controller who assist in the performance of the contract, such as persons performing financial, accounting, tax, legal activities, data processors (if necessary for their performance), accountants (for the performance of accounting obligations), legal experts in the event of legal claims, and the competent authority or court.

Privacy notice for natural person representatives and contact persons of contracting partners (companies, institutions) who are not data subjects

If you are a natural person representative of our contracting partner who is not a data subject, or a contact person designated during the quotation process or in the contract concluded, we will process the following data concerning you

Name, company telephone number or, in the absence of a company telephone number, company email address or, in the absence of a company email address, any other email address you provide, job title

Purpose of data processing: to maintain contact during the quotation process, to negotiate contractual terms and conditions, to designate the data subject as a company representative or contact person in contracts, to maintain business contacts with contractual partners as a contact person

Legal basis for processing: the legitimate interest of the controller and its contracting partner, i.e. that the contract can be concluded in accordance with the agreement of the parties, that the contract is duly signed by the natural person representing the contracting partner and that the contracting parties can maintain business contact during the performance of the contract through the designated contact person.

The data may be accessed by the employees and fulfilment partners of the controller who assist in the performance of the contract, such as persons performing financial, accounting, tax, legal activities, data processors (if necessary for their performance), accountants (for the performance of accounting obligations), legal experts in the event of legal claims, and the competent authority or court.

The controller shall retain your personal data during the performance of the contract and for 8 years after the termination of the contract pursuant to Section 169 of Act C of 2000 on Accounting.

If you do not wish to provide your personal data, it will not be possible to enter into a contract or business relationship with a business partner who is not a data subject.

 

 

 

Privacy notice for job applicants

The protection of the personal data of our applicants is a priority for us. We inform you that by submitting your application, you will be included in the company’s database of applicants. Please be informed that, in accordance with the requirements of the applicable legislation, the personal data provided in connection with your application will be treated confidentially and will not be disclosed to third parties.

If you apply for a job at MIELL GreenLife Kft, we will process the following data concerning you:

Name, name at birth, mother’s name, place of birth, date of birth, tax identification number, social security number, identity card number, address, place of residence, nationality, bank account number, assessment of the aptitude test, details of educational attainment, number of qualification certificate, details of professional experience, passport number in the case of foreign workers; name and number of documents proving entitlement to work, residence;

The purpose of the processing: filling the advertised job, concluding the employment contract; contacting the applicant on the basis of a later advertised job application for the same or a similar job, filling the job, concluding the employment contract, determining the suitability for the job, in the case of foreign workers, applying for a residence permit in order to conclude the employment contract.

Legal basis for processing: the legitimate interest of the employer, i.e. to select the most suitable candidate for a vacancy and to fill the vacancy and to conclude an employment contract with the applicant found suitable; or to select the most suitable candidate by contacting the applicant in connection with a subsequent job advertisement, to fill the vacancy and to conclude an employment contract with the applicant found suitable, and the applicant has a legitimate interest in filling the vacancy or the subsequently advertised vacancy if found suitable.

The data may be accessed by the manager entitled to exercise employer’s rights at the employer, by employees and fulfilment partners performing labour-related tasks, and, in the case of enforcement of claims, by the competent authority or court.

Your personal data shall be retained for the period of time required by labour and other relevant legislation in the case of a successful application, and for 5 years from the date of submission of the application in the case of an unsuccessful application, after which time the unsuccessful application materials shall be deleted in full.

Please be informed that, according to the 2016 Information Notice of the National Authority for Data Protection and Freedom of Information on the basic requirements for data processing in the workplace, the controller may, during the recruitment process, access publicly available, job-relevant personal data of the job applicant posted on social networking sites. In this context, please also be informed that the company advertising the job application shall not save, store or transmit any personal data relating to the applicant’s page on social networking sites.

If you do not wish to provide your personal details during the application process, your suitability for the job cannot be assessed by the employer and you cannot be considered for the job.

If you fill the vacancy, you will be subject to the data protection rules applicable to employees, details of which shall be provided to you at the time of the establishment of the employment relationship.

 

Your rights regarding the processing of your personal data

Right of information: you have the right to receive at any time, in writing or orally, appropriate information about the processing of your personal data, based on your reasoned request. Upon request, appropriate information must be provided within one month (with a possible extension of two months), for which no fee shall be charged.

Right of access: you can request, at any time, feedback on whether your data is being processed, what kind of data is being processed (if you did not provide it directly), to whom, where it will be transferred, how long it will be stored, etc., i.e. any information about your personal data, including the fact of automated decision-making, profiling. You may also request a copy of the data upon request.

The right to rectification: you may request the correction of inaccurate or incomplete data within a reasonable time.

The right to erasure: you may request that your data be erased from the database within a reasonable period of time if it is no longer necessary for the purposes for which it was collected, if you withdraw your consent to the processing of your data, if you object to the processing of your data or if your data have been unlawfully processed. (You may not have your personal data erased if the processing of your data is necessary for a legal obligation.)

Right to restriction of processing: if you dispute, for any reason, that your data is being processed adequately, you can restrict the use of your data until this is clarified.

Right to object: you can object to the processing of your data at any time, in which case the controller may no longer process your data.

Right to apply to court: if your rights concerning the processing of your data are infringed, you have the right to apply to court.

The right to data portability: you may, if you so request, receive your data on an electronic storage medium or request that the controller transfer them to another controller.

No automated decision-making or profiling shall be carried out on the basis of your data. In order to protect your personal data, paper documents shall be stored in a locked, secure place, and only duly authorised staff shall have access to your data stored electronically.
